By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access or use our Services.
Eligibility
To use our Services, you must:

- Have the legal capacity to enter into binding contracts
- Operate a legitimate restaurant or food service business
- Provide accurate and complete registration information
- Comply with all applicable laws and regulations
Account Registration and Security
When you create an account with us, you must provide information that is accurate, complete, and current. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your account information remains up to date
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.
Services Description
Delizioso provides a comprehensive restaurant management platform that includes:
- Digital menu management and QR code generation
- Order processing and payment integration
- Analytics and reporting tools
- Customer engagement features
- Multi-language support
- Reservation and queue management
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.
Subscription and Payments
Subscription Plans
Our Services are offered on a subscription basis with various pricing tiers. Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan.
Payment Terms
- All fees are non-refundable unless otherwise stated
- You authorize us to charge your payment method for all applicable fees
- Subscription automatically renews unless cancelled before the renewal date
- We may change our pricing with 30 days' notice
- Failed payments may result in service suspension
Transaction Fees
Delizioso does not charge commission on orders processed through our platform. However, standard payment processing fees from third-party payment providers (such as Stripe) will apply.
Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Upon cancellation:
- Your access will continue until the end of your current billing period
- No refunds will be issued for partial months or unused services
- Your data will be retained for 30 days before permanent deletion
- You may reactivate your account within 30 days without data loss
Acceptable Use Policy
You agree not to use our Services to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Transmit harmful or malicious code
- Attempt to gain unauthorized access to our systems
- Interfere with other users' access to the Services

Service Availability and Support
While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted access to our Services. We may experience downtime for:

We provide customer support via email and in-app messaging. Early adopters receive priority support with direct founder access.
Disclaimers and Limitations of Liability

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of content
Limitation of Liability
To the maximum extent permitted by law, Delizioso shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Third-party actions or content
Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Delizioso, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights

Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice, for:

- Fraudulent or illegal activity
- Non-payment of fees
